These Terms of Service ("Terms") govern your access to and use of GateClerk, a software-as-a-service platform for admission ticketing and gate management, operated by StormPay Inc. ("GateClerk," "we," "us," or "our"). By registering for or using GateClerk, you agree to these Terms.
GateClerk provides a cloud-based admission ticketing platform designed for race tracks, drag strips, and small live event venues. Features include event management, gate terminal access, walk-up ticket sales, sales reporting, and related tools. Service features may change over time.
To use GateClerk you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@gateclerk.com if you believe your account has been compromised.
GateClerk is offered on a monthly subscription basis at $79 per month. Subscriptions are billed in advance on a monthly cycle through our payment processor, Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.
We reserve the right to change pricing with 30 days notice. Continued use after a price change constitutes acceptance of the new pricing.
You agree to use GateClerk only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of all data you enter into GateClerk, including event information, ticket sales records, and customer information. We process your data to provide the service as described in our Privacy Policy.
We maintain reasonable backups but do not guarantee data recovery in all circumstances. You are responsible for maintaining your own records of critical business data.
Gate terminal functionality requires an Android tablet with Chrome browser and, for ticket printing, a compatible Bluetooth thermal printer. GateClerk does not supply hardware. See our Hardware Recommendations page for tested compatible devices.
GateClerk does not process or hold ticket revenue from your events. Walk-up ticket sales are cash transactions handled directly by you. GateClerk subscription fees are the only payments made to us. We do not take a percentage of your ticket sales.
We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, unexpected outages, or circumstances beyond our control may cause temporary unavailability. We are not liable for losses arising from service interruptions.
You may pause your subscription during off-season periods. During a pause, your account and data are preserved but gate terminal access is suspended. Billing resumes when you reactivate your subscription. Pause periods are managed through your account settings.
You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to maintain payment. Upon termination, your access to the service ends. We may retain data for a reasonable period as required by law or legitimate business purposes before deletion.
GateClerk is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free or uninterrupted.
To the maximum extent permitted by applicable law, GateClerk and StormPay Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost data, arising from your use of or inability to use the service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless GateClerk and StormPay Inc. from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use of GateClerk after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montgomery County, Tennessee.
